With the huns appeal of the transfer embargo and fine coming up on Wed, the SFA have named the panel, but probably of more relevance is that the findings of the original panel were that only "match fixing was worse" and termination of their SFA membership was discussed but ultimately decided that was too harsh.

They found that by avoiding the PAYE and other dues, the huns saved themselves £1.1m a month from August of last year onwards.

 

Given this, surely there is not a hope in hell of them getting any sort of result on Wednesday?

Alex Thomson - UEFA confirm 3 year ban CVA or not. Ticketus to go to court to get £27m off Whyte today.

 

This is excellent news if true.  Any CVA will require as much money as possible and without the "guarantee" of Euro football for 3yrs I'm not sure how they'll balance the books other than stripping the squad back to the bare bones.

 

Mind you qualifying for Euro means jack shit as it was there complete failure in this years competitions that precipitated this whole thing.

“Having regard to its view on the undoubted gravity of the breaches, the Tribunal considered whether it should terminate Rangers FC membership of the Scottish FA and concluded that punishment was too severe.

 

“It considered whether suspension of membership was a less serious but an appropriately severe punishment, but concluded that too was too severe.”

 

Explaining the severity of the punishment handed down to the club, which was heavily influenced by their failure to pay taxes, it is said the tribunal felt that “the registration prohibition struck a balance which was relevant to the mischief and proportionate to the breach.”

 

The document continues: “It appeared to the Tribunal that in a case such as this the punishment should relate in some meaningful way to the unpaid taxes arising from high wages and salaries amongst certain players.

 

“It appeared to the Tribunal that a temporary prohibition on registering any new players during a period of twelve months was a suitable, relevant and proportionate sanction.

 

“The Tribunal recognised that it would place pressures on Rangers FC and accordingly limited the period and specifically excluded from the prohibition the registration of persons under eighteen.

 

"The Tribunal was of the view that whilst the sanction was severe it was not excessive and that the period covered only two signing windows.

 

"It was, of course, unknown what capacity Rangers FC may have during that twelve month period for signing and registering new players in any event."

That shortly before 19 September 2011 Mr Ken Olverman was aware that Rangers FC were due to make a payment to HMRC in respect of PAYE income tax, National Insurance Contributions and Value addedTax. On making enquiry with Mr Craig Whyte about said payments,he was not authorised to make the payment which was therefore notpaid on the due date. Upon his expressing his concern to Mr CraigWhyte Mr Ken Olverman was in due course instructed that paymentsto HMRC were to be suspended and withheld. At the time of the first withheld payment in September 2011 Rangers FC’s financial situation

was such that it could have made the payment due to HMRC.67.

 

That in the course of his subsequent communications with Mr CraigWhyte about the payment of these social taxes due to HMRC Mr CraigWhyte stated to Mr Olverman that non payment of the sums due was a tactic or negotiating ploy intended to improve the position of Rangers FC in any attempted negotiation with HMRC of a settlementin “the Big Tax Case”.
