Integrity is beyond purchase. It's important to us that the integrity of the competition that we take part is maintained to the highest standards.  It's not a question of any sum of money in return for that integrity.  It's important that all clubs can have a place within football provided they have earned it in a sporting sense and have abided by the rules.

This is a bit disappointing if true (taken from RTC blog):

 

May I draw the attention of those discussing the content of the SFA Judicial Panel judgement the following paragraph which I suggest is the single most significant so far as the forthcoming appeal is concenred.

 

“The Tribunal was aware that the Judicial Panel Protocol provides not only for fines but in relation specifically to Charge 4 (bringing the game into disrepute) also the imposition of additional sanctions up to and including termination of membership if the Scottish FA., suspension and a range of other supplementary penalties.”

 

What is most striking about this paragraph in an otherwise detailed and carefully considered judgement: is where does it so provide?

 

One might have expected some reference to be made to the particular provision relied upon to impose the 12 month registration moritorium. When the original short press release was issued the relied on provisions were stated as being SFA articles 94 & 95 but the latter of these has no relevance since RFC was not charged with breach of the SFA articles which is what article 95 is concerned with. Striking that no reference is now made to article 95 in the full judgement.

 

I predict that on Wednesday the appeal tribunal will uphold the part of the RFC appeal that relates to the 12 month registration moritorium and will quash that part of the sanction because the original panel had no power to impose that sanction for breach of Disciplinary Rule 66 (i.e. the disrepute charge); there being no provision in the Judicial Panel Protocol to impose sanctions for breach of Disciplinary Rule 66 other than those in the table (the table does not allow for registration moritoria for breach of Disciplinary Rule 66) and will otherwise adhere to the decison of the panel.

 

This would be consistent with how Lord Carlloway dealt with the Dundee FC SFL appeal aginst its sanctions for goiung into administration where he revoked the third part of the sanction i.e. the elemant relating to the SFL Board attempting to retian the right to impose further sanctions if Dundee FC remianed in adminisrttion on 31 March following its administration because the SFL Rules gave it no such power.

 

He will regard all other elements of the sanctions i.e. the fines, as being within the powers of the panel and will uphold them. Likewise he will not impose expulsion from memebrship because it was wiuthin the discretion of the panel to decide not to expel RFC so he will not seek to second guess the panel on that issue.

 

Bear in mind that the fines on RFC will likely be regarded as being part of the debts of RFC so the SFA may only get the same pence in the pound as other creditors. Wonder how the SFA will vote on the CVA resolution?

so when people said they'd get away with a slap on the wrists, that was actually an over-estimation? The only punishment is a fine, which will either be payable at a massively reduced rate, or non-applicable, depending on CVA or newco. Excellent. Fantastic. Amazing. Awesome.

Seems to me that with talk of CVA more optimistic than it has been for some time this will be crucial in what kind of rangers we see in the next few years.  Crucial to rangers functioning as a viable business will be restructuring of the wage bill which will mean selling a number of players, which will also help pay off the debt, and replacing them with cheaper players.  Mind you this then will have an impact on all the Champs League money they seem to be determined to rely upon.

GREEN ALREADY HAS A WAR-CHEST FOR ALLY

 

CHARLES GREEN'S consortium will hand Ally McCoist a multi-million pound war chest this summer – if the Scottish Football Association can be persuaded to drop their transfer embargo.

 

Express Sport spoke to one of Green's backers, former Sheffield United owner Mike McDonald, and he admitted that their group have serious wealth that has been put together from the medical worlds of Kuwait, Abu Dhabi and Singapore alongside major investment from European and UK property developers.

 

Top football agent Paul Stretford will also have a major involvement in the football operation, helping the club to buy and sell players.

 

McDonald admitted that once Green's consortium complete their takeover and sort out the debts they are willing to plough significant amounts into the team to help McCoist's team to become big players in Scotland and the Champions League.

 

That investment, however, may have to be delayed unless Wednesday's SFA appeal against their one-year transfer ban is overturned.

 

"It is pointless to get involved if we weren't going to invest in the playing side right away," McDonald stated.

 

"We see that as a major priority, although, obviously, that is dependent on the Scottish Football Association's transfer embargo. We know that Ally McCoist needs to strengthen his team and also to keep some of the players he already has at the club.

 

"We have got all our funding together for every aspect of the take over and now it is just a case of sorting it out. Charles has had a good conversation with Ally McCoist and we want him to carry on managing the team. Charles has brought significant funds to the table because we know we need hundreds of millions to be successful at this level.

 

"There are a lot of people who are in this game for the publicity and think they can run a football club on a shoestring but it just isn't possible, I know that. We will not be throwing silly money at things like Manchester City but we know we have to have enough money to carry our plans out."

 

It was McDonald who advised Green to get a group of businessmen together if he was really serious about buying Rangers.He admitted: "That is the reason why there is a consortium involved because unless you are a sheikh or you have extreme wealth then it is very difficult for one person to fund a big-name football club, like Rangers.

 

"I told Charles that if he wanted to do it then he would need to go down the road of a consortium so we would have the financial clout that Rangers needed. Charles has gone away and done that and that is why we will have money coming from Europe, the UK, Kuwait, Abu Dhabi and Singapore."

 

McDonald has also assured the Rangers fans that Green's consortium are the real deal. They have the funds and the backers and they also know the football world and are committed to the club in the long-term – with the Champions League success their ultimate goal.

 

"Every one of the consortium wants to get Rangers back where they should be," McDonald admitted. "It is a massive club and it should be at the forefront of British and European football. Why can't that be done? I know it can't be achieved overnight but we have a long-term plan to achieve that goal. We have to sort the club out and to get them back on a stable and sound financial footing. Charles is definitely in it for the long haul."

 

Green has been given the green light from Duff and Phelps to take Rangers out of administration and they hope to have their deal completed by next month.The new owners plan to go down the road of a Creditors Voluntary Agreement although they have put a fall-back newco plan in place should they fail.

 

They are also aware many of McCoist's first-team can also leave this summer as a result of clauses put into contracts when they agreed wage cuts with the administrators.

Perhaps, but surely if they get a cva they will be off loading a few players to cut the wage bill.  These guys will need to be replaced as their business model requires European Football which they might not get with a team of kids.

In fact does there business model not require Champions League Football?  They are aware we will only be getting on spot in the CL for the foreseeable future thanks to Rantics god awful record in recent years?  Fucking house of cards

Livingston have written to the Scottish Football Association warning they may take legal action if the governing body fails to act upon Rangers' financial woes appropriately.

 

STV understands the First Division club have outlined they would pursue up to £1.2m in lost revenue for their relegation to the Third Division in 2009 if the SPL side are not dealt with in a similar manner.

 

The decision to demote Livingston, who were in administration but in the hands of prospective buyers, was made by the Scottish Football League prior to the start of the 2009/10 season.

 

A failed appeal to the SFL was followed up by a submission to the Scottish FA, who ruled the punishment was fair and reasonable.

 

The governing body’s judicial protocol was given a complete overhaul last year and insolvent clubs, as well as any appeals processes, are now handled in a different manner.

 

Nonetheless, Livingston believe a precedent was set in the judgement and have now stated they are monitoring how the Scottish FA are handling the Rangers situation, as uncertainty over the future of the club continues.

 

If prospective buyer Charles Green is unable to strike a deal with creditors to take the club forward via a CVA, it is possible the businessman will pursue a ‘newco’ route to ensure the club continues as part of a new company.

 

The move, which would be unprecedented in Scottish football, would require Scottish FA approval to go through if the new company wished to inherit Rangers’ membership of the body and could be subject to further sanctions.

 

Rangers have already been punished by both the Scottish Premier League and Scottish FA for being in administration, with the latter recently administering a 12-month registration embargo and fines reaching £160,000.

 

Rangers’ appeal against the Scottish FA’s sanctions, which were described as to have “struck a balance which was relevant to the mischief and proportionate to the breach” will be held on Wednesday.

 

The independent panel set up to consider the initial case against the club stated in their deliberations that "only match fixing in its various forms might be a more serious breach” than Rangers’ failure to pay tax contributions for employees, amongst other discrepancies.

 

Termination of Rangers’ membership to play football in Scotland was also considered at the time, something which was ruled to be “too severe” a punishment.

 

Both the Scottish FA and Livingston declined to comment on the letter.

I think it would be. I doubt it would be that difficult for them to attract some half-decent players for free, who will play for next to fuck all, just so that they can play for the Peepil.

 

The ban should stand.

It did not take what happened over the last few months for any of us to realise how much our great club is hated . We as a support are fully aware of the enemies lurking in the darkness , emerging with a passion of hate that surpasses the love we have for our club . Everyone knows who the main culprits are. From radio stations to cowardly foreign failed social workers . A couple of years ago our fanbase maybe underestimated the threat they posed , but not now ! . Rangers f.c. were and probably still are in a vulnerable state , and as a support we have found an inner strength to cope through this dreadful period in the clubs history .

It is now for our owners to be made fully aware of these enemies . In the future there will be an attempt to make us a global brand and its at this time when our owners need to be prepared for how far certain people will go to derail this . Our club has become an unhealthy obsession to many lowlife from the other side of the city . An example is of uefa being bombarded by thousands of emails of lies and false accusations from one person in particular . So from this moment on we all must protect this great institution from anyone who is not a Rangers man . This club will now go from strength to strength and will be back in its rightful position if our owners think the same as us

What's Dunfermline's take on this?

 

Surely by the Huns stringing this out they neither know if they will be in the Premier or 1st Division next year.  Their budget is surely going to depend heavily on knowing which league they will be in.

 

Would be good if they started legal proceedings for this to be wrapped up sooner rather than later.  ;D

I remember reading not so long ago the opposite, that only county would be promoted.  Fuck knows either way, its probably irrelevant anyway given the huns are likely to slime their way back in
