Nicholas Simmers, 29, from Aberdeen, was found with smoke bombs near the Dundee club's Tannadice stadium before the New Year's Day game. Findlay Duncan, 21, from Inverurie, was arrested after several flares were set off in the Aberdeen end of the ground. Sentence was deferred on the pair when they appeared at Dundee Sheriff Court. Fiscal depute Douglas Wiseman said that before the match, which Aberdeen won 2-1, police had been called to the Ambassador Bar following reports that a smoke bomb had been set off. Simmers was stopped near the ground, where he was found to have three smoke bombs in his possession. Duncan was arrested inside the stadium after several flares had been let off in the Shed end which was housing the Aberdeen fans. When police entered the stand they saw him holding a black canister, which he placed under his seat. He admitted being in possession of a smoke grenade, while Simmers admitted having three flares. Sheriff Tom Hughes deferred sentence on the pair until later this month. He told Simmers that the use of flares was "causing considerable panic in sports grounds in Scotland, and it has to be stopped". Deferring sentence on Duncan, he added: "These matters are taken very seriously by the courts and they will almost constantly carry a custodial sentence. "This needs to be gotten rid of from Scottish football." He banned both men from attending football matches until they appear for sentencing, and warned them that they should expect to be subject to a football banning order. Clearly overkill from this part-time sheriff - doing a quick google he has form, locked up a diabled women who turned up a disabled woman who couldnt walk and missed her bus so was 20mins late in court..... She said: "A witness, who is a serving sheriff in Scotland, boarded the train at Glasgow with his young son. "Their reserved seats were occupied with Rangers fans, but they took other seats. As the train departed the accused and his group started to sing football songs together. "About 20 minutes into the journey they started singing sectarian songs with the words 'We're up to our knees in f****n blood'. "They continued 'f*** the Pope and the IRA', 'f****n b******d', 'no surrender to the f****** IRA scum' and 'Tommy Burns is a f****** skeleton'. "The sectarian singing thereafter continued all the way to Dundee, a journey of one hour and 20 minutes. "Between Perth and Dundee the group were constantly on their feet singing, shouting and banging their fists repeatedly on the roof of the coach. "As the train approached Dundee some of the currently unidentified members of the group approached the Sheriff, who was wearing a green fleece jumper, and said to him 'are you a f****n b*****d?' No jail for him just a £500 fine and a years football ban..... Quote
tom_widdows Posted January 5, 2014 Report Posted January 5, 2014 Tis the hot topic at the moment People attacking babies is last months news Presume they will be charging them under the firework laws which has a max sentence of 3 months for illegal use. Add health & safety breach, illegal possession, public nuisance, reckless endangerment, possibly being drunk and disorderly, attempting to hide the evidence (however pointless). vandalism, breach of the peace (irony). Of course will a custodial term actually deter the morons or make it more of a thrill for them? Quote
